Battle for abortion between Washington and Texas

The right to abortion is the subject of a legal battle in the United States between the federal government and Texas.

The Biden administration filed a complaint after the adoption of a law drastically limiting the terminations of pregnancy in the conservative state in the south of the country.

There it is now impossible to abort after 6 weeks of pregnancy, at a stage where most women do not know they are pregnant.

According to family planning associations, 85% of abortions performed so far in Texas took place after six weeks.

The law that came into force on September 1 does not provide no exception in case of rape or incest, but only for a medical emergency.

This legislation “is clearly unconstitutional with regard to the case law of the Supreme Court”Justice Minister Merrick Garland said at a press conference on Thursday.

The Supreme Court of the United States guaranteed in 1973 the right of women to have an abortion and then specified that it applied as long as the fetus was not viable, ie around 22 weeks of pregnancy.

The Republican governor of Texas, Greg Abbott, showed him his “confidence in the courts”, while accusing Joe Biden of simply wanting “to distract from the disastrous evacuations from Afghanistan and its unconscious migration policy”.
