The Government intends to incorporate undocumented immigrants into the labor market


The government wants regularize migrants in an irregular situation who are trained in sectors where there are no workers. The Council of Ministers already agreed this week to authorize the urgent administrative procedure to modify the Regulation of the Law on the rights and freedoms of foreigners in Spain and their social integration.

The Ministry of Inclusion, Social Security and Migration has confirmed to Europa Press that works on a draft to reform some issues of immigration regulations and has recalled its commitment to do so from the beginning of the legislature. Said reform would include the modification of some current measures and the creation of new figures.

“It is not agile enough (current legislation) to respond to bottlenecks that occur in the labor market and generates highly bureaucratic and complex procedures”, has admitted the Ministry, who has specified that the normative procedure is in the initial phase for which it has avoided giving more details. The Minister of Inclusion, Social Security and Migrations, José Luis Escrivá, plans, however, to present this noon the balance of the first six months of operation of the reform of the Immigration regulation that came into force in October 2021.

The draft of the decree on which the Government is working, according to El País advanced this Friday, it will expand hiring at source to other employees beyond temporary ones, it would allow foreign students to work and obtain papers for immigrants in an irregular situation who are trained for positions in which workers are needed. Organizations that work with migrants estimate that some 500,000 foreigners reside in Spain in an irregular situation, although there are no official figures.

One of the pillars of the reform is to change the model for contracting foreigners who are still in origin and which allowed the recruitment of seasonal workers for campaigns such as the one for the Lepe strawberry. The Ministry now intends to extend this formula to sectors such as transport or construction.

Likewise, the decree that the government is preparing also foresees changes in the types of rooting and a new type of rooting could be created conditioned to job training in specific sectors in which there is a lack of workers. Another option to obtain rooting that could be contemplated in the reform is to have received the minimum vital income for one year or to prove a legal work activity of at least six months for foreigners who have been in Spain for two years.

And, in order to fight against the black economy, the possibility is opened that, if irregular employment by the worker or any other person is reported to the labor authorities, the affected foreigner could obtain regularization without proving a stay minimum in the country.

Regarding international students, they would be allowed to work and study at the same time and it would be easier for them to stay in Spain when they finish their training.
