The Electoral Board of Andalusia denies Podemos its entry into the left-wing coalition


  • The decision of the body, which alleges that the registration application arrived outside the legal deadline, can be appealed before the Central Electoral Board

The Electoral Board of Andalusia denies Podemos its entry into the coalition for the Andalusian elections. In a resolution known this Saturday, May 7, the agency argues to deny it that the emails with which entry was requested they arrived after the deadline. Specifically, the document includes: “The Electoral Board of Andalusia has agreed not to accept the request for the constitution of the electoral coalition Podemos Andalucía – Izquierda Unida Andalucía – Más País Andalucía – Verdes Equo – Alianza Verde – Initiative of the Andalusian people: For Andalusia submitted by email on May 7, 2022 (0:14 a.m. and 1:07 a.m.), as the application was submitted after the established deadline had elapsed”. The decision of the Electoral Board of Andalusia can be appealed before the Central Electoral Board.

The Andalusian left closed an agreement late on Friday, at the limit of the hour in which the legal term to register candidacies closed and after 48 hours of strong tensions due to the election of the candidate. Podemos agreed in extremis to attend with the rest of the formations to the Andalusian elections on June 19 with immaculate grandson as a candidate for the presidency of the Junta de Andalucía. Yolanda Díaz was thus able to launch her commitment to the understanding of different forces at the first stop of her project.

We can not arrive on time

So tight were the deadlines that the representative of Podemos did not arrive on time at registration to bring the definitive agreement signed. At 10:30 p.m. a document was closed with the coalition under the brand Through Andalusia where the signatures of the parties that at that time were within the pact -IU, Más País, Equo and the Andalusian People’s Initiative- came, waiting for Podemos to add. After the latter joined, and since no one from the purple party came with the final text, the rest of the parties registered the pre-existing document, so that Podemos does not appear in the official agreement presented to the Electoral Board. Those of Ione Belarra allege that they sent the form at 11:57 p.m. to IU, to whom make responsible of having registered a coalition without counting on them. The circumstance occurs that the coalition had to be physically carried on paper with all the forms, thus preventing the process from being completed.

Minutes after registration closed, a party representative appeared with the signature. But it was already late. This being the case, it remains to be seen whether the political agreement reached effectively translates into a valid coalition in legal terms, something that will have to be decided by the Central Electoral Board. In case it is not accepted, Podemos would not be formally within the coalition. The solution is not simple.

While some parties involved they trust that it will be rectifiable, does not seem so clear for legal purposes. One of the formulas to concur together, in case they are not legally admitted to the coalition, would be to integrate Podemos leaders into the lists without the party having a formal presence. Although this option serves as a solution for maintain the distribution of representatives of the different parties, it would be difficult in economic terms, since it would prevent the distribution of resources between the formations, and would put Podemos in serious difficulties in receiving income from the public treasury, taking into account that all the parties with representation must spend review by the Court of Auditors.
