TEPJF confirms that AMLO’s visit to Sonora violated the ban by revocation of mandate


The Superior Chamber of the Electoral Court of the Judicial Power of the Federation (TEPJF) confirmed that the visit, on February 12 and 13, by President Andrés Manuel López Obrador to sound, constituted acts such as government propaganda disseminated during the prohibited period of the mandate revocation process. For this reason, he ratified the suspension of various publications related to said activities of the president.

In a private session, the magistrates of the Superior Chamber of the Court confirmed -unanimously- the issuance of precautionary measures due to various acts carried out by President López Obrador, considering that they constituted the dissemination of government propaganda carried out during a prohibited period.

This as part of a complaint filed by the National Action Party (BREAD) before the TEPJF and requested the ruling of precautionary measures against the President of Mexico, since it considered that the promotion published on the website https://lopezobrador.org.mx, and in turn disseminated on official social networks, regarding of the work meetings that the public servant carried out on February 12 and 13 in the state of Sonora, implied in appearance of good law and in a preliminary study, government propaganda spread during a prohibited period.

Previously, the Complaints and Denunciations Commission of the National Electoral Institute (INE) had already considered that the publications highlighted actions carried out by the Executive Power, mainly the performance of public works.

The INE determined that the President highlighted benefits that they reported to the inhabitants of certain areas, for which it was considered government propaganda.

Therefore, having disseminated government propaganda during the revocation process, a period that prohibits such actions, it was considered that he acted improperly.

It should be noted that President López Obrador challenged the determination of the INE, for which the plenary session of the Upper roomat the proposal of Judge Indalfer Infante Gonzales, confirmed the issuance of precautionary measures by the INEbecause the manifestations of acts of government by López Obrador were aimed at disseminating achievements, advances, investment, projections and benefits achieved by a government program, actions that in a preliminary study and in appearance of good law, what was foreseen in article 35, section IX, section 7 of the Political Constitution of the United Mexican States.

For this reason, the full Superior Room of the TEPJF confirmed the origin of the precautionary measures and the order to eliminate the denounced publications, related to the acts of government carried out by the president. On the other hand, the Superior Chamber confirmed the adoption of precautionary measures, in its preventive protection aspect, so that the head of the Executive refrains from issuing any type of government propaganda during the prohibited period.
