Permanent prison for the man who let his diabetic girlfriend die

The Court of Barcelona has condemned reviewable permanent prison to the man accused of letting his diabetic couple and of recording her agony with her mobile, without helping her despite her state of vulnerability, in June 2019 at her home in Viladecans (Barcelona).

In the sentence, the Court of Barcelona, ​​in accordance with the verdict of the popular jury, attributes to the defendant, Mariano Daniel Vásquez, a crime of murder with crueltythree of mistreatment in the field of sexist violence, one of habitual mistreatment and one against the intimacy of women, a person “especially vulnerable due to his illness”.

The sentence considers it proven that between February and March 2019 Mariano Daniel Vásquez maintained a sentimental relationship, without living together, with the woman, and that over time he imposed himself on the victim, controlling and belittling her in public and in private, causing that she felt inferior, and that he also hit her on several occasions.

On the night of June 17, 2019, according to the sentence, the woman was very ill and called Mariano to come to her house to help her. When the man arrived at the victim’s home, he found her physically very deteriorated, with respiratory difficulties and unable to do anything on her own, although he did not give her any help and watched her deteriorate, losing consciousness. and his life was “extinguished”, until he suffered hyperglycemia that caused his death.

According to the Court, the woman’s death “would not have occurred” if the man, seeing her condition, had requested help from the emergency medical services. In addition, the sentence highlights that the defendant recorded the woman in her progressive deterioration with a mobile phone “to show the images to third parties”, to try to make them see that he cared for her “and thus build an alibi” in case it was investigated. his death.

“Being easy for the accused to ask for medical assistance, his passive behavior in this regard, since he neither asked for medical assistance nor help of any kind, when it was evident, in view of the recording, that the dying woman could not ask anyone for help , it must inevitably be concluded that Mariano wanted the death (of the victim) to occur or that he was indifferent to it, “says the sentence.

Regarding cruelty, he assures that it is evident that in this case it is not determined by the long agony suffered by the victim, since the accused cannot be blamed for the woman not dying before, but rather for letting her die without “doing anything” to avoid it.

“The accused increased the victim’s pain with his burlesque behavior, which he also recorded on video, with the woman in such deplorable conditions that she surely would not want anyone to see her,” the Court underlines. In fact, one of the main pieces of evidence used by the jury to support its conclusions were the videos that the defendant himself recorded in the victim’s home when she spent hours in a dying state and in constant deterioration of his physical and mental faculties.
