According to the Court, the woman’s death “would not have occurred” if the man, seeing her condition, had requested help from the emergency medical services. In addition, the sentence highlights that the defendant recorded the woman in her progressive deterioration with a mobile phone “to show the images to third parties”, to try to make them see that he cared for her “and thus build an alibi” in case it was investigated. his death.

“Being easy for the accused to ask for medical assistance, his passive behavior in this regard, since he neither asked for medical assistance nor help of any kind, when it was evident, in view of the recording, that the dying woman could not ask anyone for help , it must inevitably be concluded that Mariano wanted the death (of the victim) to occur or that he was indifferent to it, “says the sentence.
