Inai orders the SHCP to make public the report on the tender to purchase medicines in 2019

The National Institute of Transparency, Access to Information and Protection of Personal Data (Inai) resolved that the Ministry of Finance and Public Credit (SHCP) must deliver a copy of the report on the International Competitive Bidding in relation to the acquisition of medical supplies for fiscal year 2019 that was delivered by the United Nations Office for Project Services (UNOPS) to the agency and to the Ministry of Health (SSA).

Through a statement, it was specified that the person who requested to know the Report filed an appeal for review before the Inai, because the SHCP, through the Mayor’s Office, declared the non-existence of the information.

At that time, the SHCP It indicated that, although it has powers to coordinate consolidated purchases, carried out within the framework of the Law of Acquisitions, Leases and Services of the Public Sector (LAASSP), in the specific case, the purchase was not carried out under said legislation.

Said agreement indicates that the contractual purpose was the consolidated acquisition of therapeutic goods for fiscal year 2019 and that said tender was carried out under the terms and procedures of the Law on Acquisitions, Leases and Services of the Public Sector and its regulations.

The Inai recalled that derived from the results obtained from the first construction exercise of this new consolidated procurement model, “UNOPS developed a series of lessons learned and recommendations for improvement, the purpose of which was to establish a planned purchasing strategy with a view to optimizing processes and get better prices ”.

These recommendations can be found in the report on the general result of the international purchasing process, delivered by UNOPS to SHCP Yet the Health Secretary.

In this way, it was concluded that said report is the document requested by the interested party and that, contrary to what the SCHP, the tender procedure in question was held in terms of the Law of Acquisitions, Leases and Services of the Public Sector, so there is no certainty in the search for the information.

“The lack of sufficient, affordable and quality medicines puts at risk the continuity in the prevention, treatment and control of diseases, and also makes it difficult for the population to receive adequate medical care, reducing the opportunities for people to count with equal conditions in order to reach the highest possible level of health ”, warned Ibarra Cadena.
