After receiving the communication, the instructor phase will begin (for a maximum period of three months), which will culminate in the issuance of a report that will entail either the filing of the file due to the possible existence of fraud or corruption, or the initiation of the sanctioning procedure. The Authority may collaborate with the Public Prosecutor’s Office when it considers that the act that is the subject of the communication constitutes a crime. In addition, the Independent Authority will act in the protection of informants. The person holding the presidency of the Authority shall have undersecretary rank and will be appointed for a period of five years non-renewable, among people of recognized prestige. He must appear annually in Parliament.
In the memory of the draft bill, it is estimated at 5.74 million euros the cost to set up this body, for which it is planned a staff of 28 people. In the first year it is expected to have 1.86 million from European funds for the implementation of a digital structure that guarantees the confidentiality of communications. It is expected that, in the medium term, the organism can self-finance from the income from the sanctions imposed.
