Claro TV concession for pay TV could be resolved in court: IFT

Claro TV’s request to obtain a concession that allows it to distribute pay television content nationwide in Mexico could ultimately be resolved in specialized courts and even in the Supreme Court of Justice of the Nation (SCJN), recognized the Federal Institute of Telecommunications (IFT), authority empowered to authorize or deny the request to this company related to the economic interest group América Móvil (AMX) and the Slim family.

“This could end up being resolved in the courts, it is a possibility”, expressed the commissioner president of the institute, Adolfo Cuevas.

Claro TV It was established three years ago in Mexico as a new telecommunications company and since 2021 it has an authorization in its possession, which was from its sister ClaroSat, to commercialize satellite capacity throughout the national territory. You are looking for a single telecommunications concession, with which you could sell video, television, data, Internet products or a packaged combination of those services, if the IFT decides that your request is appropriate and not contrary to market competition.

The Federal Telecommunications Institute (IFT) could even give you a concession authorized only for that service provision and prevent you from combining your offers with those of those companies considered preponderant economic agents, such as Telcel The Telmex.

The regulator confirmed this morning that its different areas, such as the Economic Competition, Compliance, Concessions and Services and Regulatory Policy units, have already drawn up reports that the regulator will use to study the Claro TV case. Right now, you already have a second document with more detailed information on the current market photograph and with scenario perspectives regarding how the dynamics of the market would change, in the event that Claro TV get your award.

The institute does not have a scheduled date to discuss Claro TV’s request, although it acknowledged at breakfast with the media that this discussion could occur at “any moment.” Industry leaks in the press indicate that the regulator will discuss the Claro TV issue on December 15 or 21.

Current legislation does not oblige the Federal Institute of Telecommunications (IFT) issues a decision on Claro TV with a minimum of seven possible votes, but the regulator wants this resolution to come out with the largest possible vote of commissioners, before the coven of comments from industry actors that will come after its determination, positive or negative for Claro TV.

The IFT is against the clock to resolve various loads of tasks, because some of them do require at least five votes from commissioners and Commissioner Adolfo Cuevas leaves office on the last day of 2022.
