Almost 90% drop in strike calls seeking the signing of a collective contract


The summons to strike, whose purpose is to achieve the signing of a collective bargaining agreement with the companies, fell 88.9% compared to the first two months of 2019, the date on which the labor reform was presented that integrates a new labor model to establish the signing of the contract.

According to data from the Secretary of labor and social security (STPS) in the first two months of this year, only 50 summonses to strike had been presented where the reason was the signing of a contract.

It should be noted that the new labor model has already entered into force and its implementation has already been carried out in 21 states; while the last stage, which includes the entities with the greatest labor conflict such as Mexico City and Nuevo León, will enter into force until October of this year.

In annual comparison, in February 2021 the strike calls were 86% higher, compared to what was reported this year; as only 27 unions submitted their summons for this reason in 2022.

The development of protection contracts, recalled Óscar de la Vega, a partner at De la Vega & Martinez Rojas, it happened because “there was a series of blackmails and bribes by trade union organizations, thousands of times it happened that we already had a summons to strike by signing a contract, when we still did not know the workers. What those unions were least interested in was the protection of workers in the construction industry, but they were canonries that existed in a corporate system where all corporate unionism was a pillar of the party of power that for 60 years was the PRI. ”.

Currently, in order to achieve the signing of a CCT, at least in the 21 entities where the labor reform has already entered into force, it is essential that the union organization has the Proof of Representativeness, which attests that it has at least 30% worker approval.

However, the unions that have operations in the entities: Mexico City, Coahuila, Chihuahua, Guerrero, Jalisco, Michoacán, Nayarit, Nuevo León, Sinaloa, Sonora, Tamaulipas and Yucatán; they can still submit summons to strike to sign a collective bargaining agreement, without having to present their Proof of Representation.

Another of the reasons why union organizations present summons to strike is for review -whether salary or contractual- but it can also be presented for the argument that there have been violations in compliance with it.

Of the trade union organizations that make up the Labor Congress (CT), is the Confederation of Workers of Mexico (CTM) the labor union that has presented the largest number of summonses in the last three years; however, it has been decreasing, until February 2022 there are 55 strike locations reported for various reasons.
