The judge would not have issued a court order on the health worker’s vaccination order

A Quebec Superior Court judge ruled that he would have denied unvaccinated healthcare workers in his request for a court order on the Quebec government’s order that they receive the vaccine.

The decision was delivered Monday morning.

The provincial government had threatened to suspend unvaccinated health network personnel without pay as of November 15, but eventually backed down. The unvaccinated healthcare workers asked the court to postpone the vaccination edict until their full legal challenge is heard. High Court Judge Michel Yergeau heard the arguments before Health Minister Christian Dubé backed down as the deadline approached.

“In this case, the applicants have not reversed the presumption that the (government) order was issued in accordance with its enabling statute and that it was made for the benefit of the general public. Therefore, it is necessary, at this stage, to leave the decree in application, ”Yergeau wrote in his decision.
