TEPJF will discuss today postponement to revocation of mandate

The Electoral Tribunal of the Federal Judicial Branch (TEPJF) will discuss this afternoon the challenge presented by the Presidency of the Republic, against the agreement of the National Electoral Institute (INE) that postponed some activities of the revocation of the presidential mandate.

The plenary session of the Superior Chamber of the TEPJF is scheduled for 6:00 p.m. this Wednesday, when the electoral magistrates will analyze the challenges presented by the Legal Counsel of the Federal Executive. The project was prepared by the magistrate Felipe Alfredo Fuentes Barrera.

Thus, the Electoral Court will rule today on whether or not the INE should continue with the activities of the revocation of mandate, and adjust to its 2022 budget as preliminarily determined by the Supreme Court of Justice of the Nation (SCJN ), or it is necessary that the corresponding authorities grant the extension to your budget.

The president of the INE, Lorenzo Córdova, and the rest of the councilors of that institute have said that a statement from the TEPJF and the issuance of rules on this issue are required. They have also said that they will abide by what is determined by both the Court and the Supreme Court.

The National Electoral Institute has explained that does not have the 3,830 million pesos required to carry out the organization and conduct of the consultation on the revocation of the mandate, and after carrying out some adjustments to its budget for 2022, it only has 1,503 million pesos for that year.

On December 22, the Recess Commission of the Supreme Court of Justice of the Nation admitted for processing the constitutional controversy promoted by the president of the Chamber of Deputies, Sergio Gutiérrez Luna, against the agreement of the National Electoral Institute (INE) which determined to postpone the execution of the Mandate Revocation process, and ordered the institute to reinstate the procedure.

“The suspension requested by the Chamber of Deputies of the Congress of the Union is granted, for the purposes specified in the final part of this provision. The suspension measure will take effect immediately and without the need to grant any guarantee ”, ordered the ministers Margarita Ríos and Jasmín Esquivel Mossa.

Five days later, the same Recess Commission accepted for processing the constitutional controversy that the Legal Counsel of the Presidency of the Republic filed against the agreement of the National Electoral Institute (INE) that suspended some activities of the revocation of the presidential mandate, and also ordered the institute to reinstate the procedure.

The National Electoral Institute (INE) said that it will abide by the first ruling of the Supreme Court of Justice of the Nation (SCJN) on the revocation of the presidential mandate, so it will adjust its procedures to the 1,503 million it has to carry out next year that exercise of citizen consultation.

The president of the INE, Lorenzo Córdova, said that the electoral body will abide by the resolution of the Court, and will remain attentive to the fact that that judicial instance resolves the constitutional controversy that it presented for not having the 3.83 billion pesos that it requires in total. to organize and hold the mandate revocation consultation.

Córdova stressed that this first ruling of the Court is provisional and does not resolve the merits of the matter.
