SCJN declares unconstitutional the extension of the mandate of Arturo Zaldívar

The Supreme Court of Justice of the Nation (SCJN) invalidated the extension of the mandate of Arturo Zaldívar Lelo de Larrea as presiding minister of the highest court.

Unanimously, the plenary of the SCJN declared the unconstitutionality of transitory article 13 of the law of reforms of June 7 of this year in matters of federal justice, which extended by two years the term of the current president of the high court.

“The Plenary held that said extension is contrary to Articles 97 and 100 of the Constitution, which establish the form of appointment and the terms of the term of the President of the Supreme Court and the counselors of the Judiciary, as well as the principles of constitutional supremacy, division of powers and judicial autonomy and independence “, explained the SCJN it’s a statement.

It should be remembered that last August, the minister president of the SCJN He resigned from the extension of his mandate until 2024 and will end his term on December 31, 2022.



On June 7, the Federal Official Gazette published the reforms to the Federal Judicial Power to professionalize its members and combat corruption and nepotism through a judicial career, which strengthens the role of the Court as a constitutional court. A transitory article of these reforms established the extension of the mandate of the current SCJN president until November 2024.
