SAT will continue to review foreign trade to corroborate compliance with tax laws

The Tax Administration Service (SAT) will continue to review foreign trade operations outside customs to verify due compliance with tax laws, this after the entry into force of the new National Customs Agency of Mexico (ANAM).

According to the information provided by the government, the SAT and ANAM will maintain “close and continuous communication” in order to carry out the functions entrusted by the decree by which ANAM was created.

Meanwhile, the agency will take care of the management, organization and operation of customs and inspection services, to apply and ensure compliance with the rules that regulate the entry and exit of goods, as well as the collection of taxes and the right of the customs procedure.

General import and export taxes are paid through customs clearance by any person who imports or exports goods or merchandise. This happens once its nature, quality, quantity and / or weight have been determined.

In the case of customs processing rights, different rates or fees are applied to determine your payment, depending on whether it is import or export, as well as the type of good or merchandise.

ANAM came into force on January 1 of this year, and was created with the objective of strengthening the Mexican customs system. It will be a decentralized body of the Ministry of Finance and Public Credit, with technical, operational, administrative and management autonomy.

One of the issues that stands out in the decree is the possibility that the armed forces occupy positions in ANAM. In accordance with the published regulations, ANAM may appoint personnel who belong or have belonged to the Armed Forces of Mexico to various positions. These positions can be the general directorates and the Administration and Finance Unit, directorates, customs administrations, sub-directorates, department heads, liaisons, foreign trade officers.

Another point to highlight is the possibility for the Secretariat of National Defense and the Secretariat of the Navy to establish public trusts without structure, to “expedite the organization and collaboration” between the authorities.
