SAT Nuevo León warns not to form an Autonomous Tax Commission

The Undersecretary of Tax Administration of Nuevo León (SAT Nuevo León), Félix Arratia Cruz, called on the state Congress to establish ties in favor of tax collection, but warned against forming an Autonomous Tax Commission, as it would jeopardize revenue collection coordinated with the federation.

“A few days ago we attended a conference at the Forum of Tax Specialists (FET), where we discussed what we have done at SAT NL regarding collection, auditing and the collaboration agreements we have entered into with the federation,” he explained. on their social networks.

He commented that in that forum he made a respectful call to the state Congress to continue building ties to strengthen tax and collection issues in Nuevo León, preserving the good relationship built with all governments and collection bodies since the creation of SAT NL.

“Creating an Autonomous Tax Commission would jeopardize the collection of income coordinated with the federation, and the participation of Nuevo León in the representative bodies of fiscal coordination,” he said.

The initiative proposes the creation of a constitutionally autonomous body that applies local tax legislation so that natural and legal persons contribute proportionally and equitably to public spending, to supervise taxpayers so that they comply with local tax provisions, facilitate and encourage voluntary compliance with said provisions, and generate and provide the necessary information for the design and evaluation of local tax policy, he said.

“The initiative ignores the federal application of fiscal regulations and collaboration with the federation, which makes it illegal, since according to article 13 of the Fiscal Coordination Law, administrative collaboration agreements must be signed by the government. through the Ministry of Finance of the state of Nuevo León, and the governments of the entities”, he stressed.

The administrative collaboration agreements themselves establish in the fourth clause, that the powers contained in the application of the fiscal legislation must be exercised by the governor of the federal entity or by the fiscal authorities that he designates, he stressed.

“The creation of this autonomous body endangers the participation of the state in the representative bodies in terms of fiscal coordination with the federation, given that the National Meeting of Tax Officials and the Permanent Commission of Tax Officials must necessarily be made up of the holders of the state treasury bodies, that is, the Finance Secretariats of each of the states”, he indicated.

Although the initiative is based on objectives and purposes that lead to decentralizing the operation of the technical functions of the state, with the creation of this autonomous constitutional body, greater uncertainty is created and the collection of revenues is endangered, which has been in increase because since the beginning of this year state revenues have been higher by more than 26%, compared to the previous year.

With a collection of 29,157 million pesos between federal participation and its own income, the state is 13 percent above what is forecast in the income budget for 2022.

The collection for the municipalities is also put in danger, since for that same reason the transfers to the city councils have increased. “At SATNL we are open to dialogue and to continue finding points of agreement to strengthen the administration of state revenues”, he concluded.

The SAT Nuevo León carries out vigilance and in-depth audit actions for the correct fulfillment of the fiscal obligations of the taxpayers, in the Payroll Tax (ISN), contributions to games with bets and raffles and ecological taxes.
