The plenary session of the Electoral Tribunal of the Judicial Power of the Federation (TEPJF) ordered the Special Prosecutor for Electoral Crimes (Fede) to deliver to the National Electoral Institute (INE) the file of the investigation folder due to the appearance of a video where it was observed to Pío López Obrador, brother of the current president of the Republic, receive bundles of money from David León, former national coordinator of Civil Protection in 2015.
In this sense, by majority vote of the magistrates, the plenary session of the Superior Chamber of the TEPJF declared founded the claim of the National Electoral Institute to order the agent of the Public Ministry of the Federation to deliver said documentation.
The court determined that the head of the Technical Inspection Unit (UTF) of the INE requested a simple copy of an investigation folder, and confirmed that the information is necessary to carry out various procedures in the area of inspection.
Before the requests, the general director of Legal Affairs and the Agent of the Public Ministry of the Federation of the Fede, had refused to grant a copy of the aforementioned documentation, for which the Executive Secretary of the General Council of the INE promoted two electoral trials.
Magistrate Mónica Soto Fregoso proposed to dismiss the trial considering that the matter was not electoral, but criminal. However, his proposal was rejected by the votes of Judge Janine Otálora Malassis and Judges Felipe Fuentes Barrera, Reyes Rodríguez Mondragón and José Luis Vargas Valdez.
This majority of magistrates determined that ministerial secrecy is not enforceable against the supervisory powers of the Mexican electoral institute.
Refusal of AMLO’s brother
It should be noted that already last October, the Electoral Court had denied Pio López Obrador’s request for the National Electoral Institute to conclude the investigation against him, thus validating that the electoral body would continue the investigations.
Last year, a media outlet released a video where Pío López Obrador was observed receiving bundles of money in an envelope from David León. The event allegedly occurred in 2015 when federal political campaigns were underway. Parties opposing Morena presented a complaint to the INE, for which the Supervision Commission of the national electoral body initiated an investigation.
On Thursday, October 7 of this year, President Andrés Manuel López Obrador ruled that his brother, Pío López Obrador, be investigated by the competent authorities and, if there are elements, be punished.
“What about my brother has already become very clear, it is evident that I do not protect anyone. I came here to lead a transformation, to do it with all the people, that is why millions of Mexicans gave me their trust and I am not going to betray them. If my brother is responsible, let him be punished. I do not establish complicity relationships with anyone, not even with the members of my family, I no longer belong to myself ”.
