Finally, the Government has presented a proposal to extend the temporary employment regulation files (ERTE) structured by the Covid, with its benefits for workers and exemptions from social contributions for companies. The extension is proposed until January 31, 2022. But it will not be automatic and its formulation registers numerous changes.
Although all ERTE situations and ultra-protected sectors are extended, companies must expressly request the ERTE extension before next October 10, including the application for unemployment benefit to workers. The Administration will have to resolve within 10 days and if there is administrative silence, the request for an extension will be deemed rejected.
In addition, the Government’s proposal links the maintenance of the Social Security quota exemptions to the company activating training actions for workers affected by ERTE. These training actions must be carried out between October 1 and June 30, 2022.
According to the UGT, “this modification has raised doubts about its application, execution and financing.” So has the one related to the rejection of the ERTE extension due to administrative silence. “It has generated a lot of controversy and generates confusion with the automatic extension that must occur at the time of the request.”
Regarding the exemptions of Social Security contributions, they are unified maintaining 100% for the ERTE of impediment. But in the case of limitation, they remain at 50% for companies with less than 50 workers and at 40% for larger ones.
On the other hand, special benefits for discontinuous permanent workers are extended and UGT has insisted on the “need to update the counter to zero of unemployment benefits for people affected by ERTE”.
