FGR requests change of precautionary measure for Emilio Lozoya; request preventive detention

Agents of the General Prosecutor of the Republic (FGR) asked a judge to change the precautionary measure against the former director of Petróleos Mexicanos (Pemex), Emilio Lozoya, for justified preventive detention.

During the hearing that has been held since this morning in the courts of the North Prison of Mexico City, to which Emilio Lozoya attended, agents of the Public Ministry asked the judge in the case to review the precautionary measure that keeps Lozoya free, as they argued that this measure was requested in certain circumstances, and until the Today, none of the defendants, including Lozoya, has met the requirements to obtain a criterion of opportunity.

Therefore, the agents of the Public ministry Federal authorities requested justified preventive detention only for Emilio Lozoya Austin.

As a third party involved, the Pemex representation adhered to the request to change the precautionary measure to justified preventive detention.

For its part, the representation of the Financial Intelligence Unit of the Ministry of Finance, argued that it has several open investigations against Emilio Lozoya, which at the time could be prosecuted. Therefore, when exposing a risk of escape, joined the request for justified preventive detention.

The defense of the former director of Pemex requested a 30-minute recess to organize arguments, which was granted by the judge.

The hearing began around 10:12 am on Wednesday for the case Odebrecht.

Based on the rights to defense and due process, the Judge authorized one month, ending on December 3, for Lozoya’s defense to collect evidence in his favor prior to the start of the trial against him. The judge urged the Office of the Attorney General of the Republic to exhaust the means to obtain this investigation data.

Initially, Lozoya and his defense had requested the judge 60 days extension of the closing of the complementary investigation.

For their part, on behalf of the Prosecutor’s Office, agents of the Federal Public Ministry expressed before the judge their opposition to the extension and they requested that the complementary investigation stage be declared closed, since the documents that the defense alluded not to know, to request the additional period, are already in the investigation folder.

As third parties involved, representatives of Pemex and the Financial Intelligence Unit of the Ministry of Finance joined the prosecution’s claim.
