Complaint against directors, persecution and intimidation: INE

As an act of intimidation and persecution that seeks to inhibit the independence of the National Electoral Institute (INE), the counselors described the criminal complaint presented by the president of the Chamber of Deputies, Sergio Gutierrez Luna (Morena), against the directors who voted in favor of the postponement of activities of the revocation of mandate.

In a letter to public opinion, the 11 advisers of the INE headed by its president, Lorenzo CordovaThey highlighted that votes in a collegiate body are natural and must be respected, since that is how decisions are made and are part of the public debate. They indicated that if there is a disagreement, the Electoral Tribunal of the Federal Judicial Power (TEPJF) is there to resolve the differences, for which Morena filed a challenge against the postponement.

“The decisions of the General Council of the OTHER They may not be shared by the different political forces and actors, therefore, the legislation provides that they can be challenged, as in this case those who felt aggrieved by such measure did. It will be the jurisdictional bodies who ultimately decide on this matter what corresponds in law and, the INE, as always, will abide by those decisions, “the letter mentioned.

In their letter, the 11 councilors described the complaint filed by deputy Gutiérrez Luna before the Office of the Attorney General of the Republic (FGR)They said that it is an intimidating act that seeks to inhibit the independence of the national electoral body.

“For this reason it is very worrying that the president of the Chamber of Deputies intends to turn a legal dispute into a criminal prosecution, with complaints before the Attorney General’s Office against Councilors who voted in favor of the aforementioned agreement, as well as against the Secretary Executive, who does not vote the decisions of the collegiate. It is an unjustified action without legal support, which seeks to inhibit the independence with which the members of the General Council assess and vote on the matters that concern them.

“Above the different positions that we have adopted on this and other decisions, the Electoral Councilors of the OTHER We reject criminal complaints against any of our colleagues and all forms of intimidation and violation of our autonomy. The differences of criteria in cases in which different solutions can be validly sustained within the framework of our legal powers, should not merit criminal prosecution, especially when those who adopt them have publicly explained the reasons for their decision, ”they said.

The counselors agreed that in a democratic state of law, differences of opinion are not prosecuted as crimes.
