Government increases exemptions for condominium dwellers age 55 and older

Last November, the BC NDP banned all rent restriction statutes in strata agreements except for 55+ strata buildings.

As a result, hundreds of Strata properties have adopted the 55+ age restriction.

On Monday, the government further tightened the Strata Ownership Law to ensure those deals were inclusive.

Here is an overview of the law and its latest amendment:

• The Strata Property Law was created in 1998 and governs the lives of hundreds of thousands of condominium residents. Metro Vancouver has around 700,000 condominium units, and the City of Vancouver has 150,000 of them.

• On November 24, 2022, the law was changed so that a strata corporation could only limit the age of an owner, tenant, or occupant to 55 years or older.

• Waivers were added to that rule on May 1 so that a 55+ stratum could not deny membership to various groups of residents.

• These groups include the future children, or any dependent, spouse or new partner of a member of the stratum.

• The children of people who live in strata over 55 years of age may also live with their parents.

• Housing Minister Ravi Kahlon said the changes were made after hearing complaints from members of strata whose strata had changed to 55 or higher.

• BC Senior Advocate Isobel Mackenzie said the latest changes have made it easier for seniors to stay in their homes.

• The government made changes to the law to increase housing options.
