Activists regret that reform of the Mining Law did not seek to eliminate company abuses

Communities, organizations and academics lamented that President Andrés Manuel López Obrador’s proposal on mining matters is not enough to reverse the violations of human rights in communities by private parties, in addition to the fact that a profound reform to the Mining Lawthat puts their self-determination and autonomy at the center.

from the collective #Let’s change it now and the Alliance for Self-Determination and Autonomy (ALDEA), organizations expressed that since its creation in 1992, the Mining Law It has privileged mining companies, made human rights violations possible and facilitated the destruction of ecosystems.

Therefore, it is urgent that the Mexican State address structural discrimination in depth, comply with its obligations to respect, protect and guarantee human rights, and reverse the imbalance of power between the extractive sector and society.

The groups made up of peoples, communities, civil organizations, movements, academics, and defenders of the land and territory, maintained that the modifications proposed by President Andrés Manuel López Obrador in his initiative on the Mining Law are insufficient to reverse this situation.

This by pointing out that although the statement of reasons for the presidential reform indicated that the Mining Law issued in 1992 was designed to protect and guarantee the interests of private companies, national and foreign, to obtain concessions regardless of the rights of the people of MexicoAnd despite the fact that they see positive that the Executive Branch seeks to put a stop to the dispossession of the territories and the privileges of the mining companies, the modification proposal sent by the Executive and approved by the Congress of the Union “is very limited, since it does not correct the violating content of the articles that have made it possible to hand over the territories to the and the systematic violations of rights against indigenous, Afro-Mexican and similar peoples and communities, as well as against agrarian groups.”

The organizations also recalled that, for more than two years, they have been promoting a profound reform of said law, which places the human and collective rights of peoples and communities at the center, including self-determination and autonomy.

Therefore, they called on the federal government to take advantage of the Executive’s initiative to make profound changes to the Mining Law.
