A graffiti artist accepts a year in prison for stoning a vigilante

  • JF and six other unidentified people attacked the security guard when they were discovered when they were going to paint wagons at the Montcada i Reixac station.

A graffiti artist has accepted the sentence of one year in prison and the payment of compensation of 700 euros for the stone attack of a Renfe-Adif security guard and the one who caused a head wound of about three centimeters of length. The prosecutor requested in his initial indictment five years in prison against JF for a crime of injury, although, during the hearing held this Tuesday at the Barcelona Court, he has modified his conclusions, lowering the request for conviction, after reaching a agreement with the defense for the application of mitigating factors for damage repair (disbursement of compensation) and drug addiction. The defendant is a habitual consumer of cannabis.

The pact has prevented the trial from being held and the court has ruled sentence ‘in voice’ in accordance with the prosecutor’s request, who also demanded that the accused be placed under a one-year restraining order against the victim. The magistrates later accepted the suspension of the sentence (that is, he will not go to jail for now) as long as JF does not commit another crime in the next two years. Being an agreement, the sentence will not be appealed and, therefore, it is final. The prosecutor in his modification of the indictment has highlighted that JF suffers from “an intense impulsiveness that causes him problems of self-control”,

The events go back to early morning on April 8, 2019, when the defendant and six other people who could not be identified accessed the train tracks of the Renfe-Adif station in Montcada i Reixac to make graffiti on the wagons. All of them except JF wore a hoodie and masks that hid their faces. The group, according to the prosecutor, “was perfectly” aware that “their irregular situation” could be perceived by the security guards. If this happened, they agreed to pick up stones from the train tracks to throw at security personnel. Or that is what happened that day when the graffiti artists were discovered.

Stones of “considerable size” began to be thrown at the victim, forcing him to move away from the place in order to take refuge. The aggression not only increased, but the group got closer and closer to him physically. It was then that the accused went directly to the security guard when he thought he was under cover with a “clear intention” to attack him. The security guard took out his baton to repel the attack and the two fell to the ground, running away, then JF to join his cronies. Once all together, the defendant and the other six people who accompanied him proceeded to throw stones at the guard again. One of them, hit him in the front of the head, which has caused him to have a small scar.

It is not the first time that this guard has had to act to scare away groups of graffiti artists at the Renfe stations where he has served, as he himself acknowledged at the door of the room where the trial was to be held. In his opinion, these urban artists always act in groups and are organized, even monitoring the movements of the staff in order to paint the train cars.
