ASF warns that CNDH and FGR should strengthen procedures in case of torture

Despite the fact that the Federal Government recognizes the crime of torture as a public problem, both the CNDH and the FGR need to strengthen the procedures for exhaustive supervision of the detention centers; as well as having a protocol of action to present complaints, denunciations or precautionary measures, the ASF pointed out.

As part of the performance audit carried out to the National Human Rights Commission on the Prevention, Investigation and Persecution of the Crime of Torture, the Superior Audit of the Federation indicated that during 2020, the actions carried out by the CNDH and the FGR for the Prevention, investigation and prosecution of this crime must be consolidated effectively, so that there is comprehensive work at the national level.

In addition to the persistence of the need to have a greater operational capacity in both the CNDH and the FGR and increase the training coverage for public servants in charge of the prevention, investigation and prosecution of said crimes, in order that they comply with their functions efficiently. While criteria and indicators are needed to facilitate timely monitoring of all the recommendations issued.

The ASF also indicated that in terms of the investigation and prosecution of the crime, there are still areas of improvement so that the records it generates allow it to document the traceability of the investigation and prosecution processes of the crime, in order to ensure that the number of preliminary investigations and Investigation folders relate to the total number of cases of torture and other cruel, inhuman or degrading treatment or punishment that the Special Prosecutor for Investigation of the Crime of Torture had to attend to.

As well as documenting that in all cases there will be a Specialized Psychological Medical Opinion to determine the criminal action, in order to make efficient the attention in the delay of the preliminary investigations and investigation folders from previous years and that a higher percentage of investigations previous reports and investigation folders, were consigned and prosecuted before a judge.

In matters of law enforcement, it was said that in 2020, there was a need for the FGR to prepare a diagnosis of the operational capacity it must have in order to have the investigative police and specialized experts required for its effective operation.

“The foregoing evidenced that there are actions to consolidate the contribution of the CNDH and the FGR in guaranteeing the integrity and security of people in detention, imprisonment or custody, in order to promote, respect and protect their rights,” says the audit report .
