In the last two years, and since the issuance of the Protocol to detect, care for and monitor cases of harassment and sexual/workplace harassmentthe Federal Attorney for the Defense of Labor (Prophet) reported that 78% of the cases presented have been for bullying and harassment.

Thus, a total of 1,589 orientation services and labor legal advice of federal jurisdiction to women for reasons of conflict related to stalking and harassment since 2020.

Regarding the mediation of conflicts, in the period from 2020 to February 2022, 28 cases have been initiated, of which 24 have already been concluded and 14 resolved favorably, thanks to which an amount of 565,108 was recovered. pesos in favor of the affected party.

The Profedet reported that it also has the function of legally representing the victims if they so request; For this reason, in the indicated period, four lawsuits have been initiated, of which two have already been concluded and one of them was resolved favorably, with an economic achievement of 150,000 pesos.

On the other hand, in accordance with the Protocol, the Attorney General’s Office can also refer cases to the authority in criminal, civil or internal control matters, as appropriate, carrying out a total of 942 referrals, of which six went to judicial instances and two of human rights.

Likewise, it offered 630 orientations and consultancies for unjustified dismissals due to pregnancyof which to date has carried out 30 conciliations and 20 trials.

In addition, Profedet has collaborated for the granting of 745 certificates of the Mexican Standard NMX-R-025-SCFI-2015 in Labor Equality and Non-Discrimination to work centers.

He recalled that the Protocol is a tool based on the basic principles of dignity, defense of people and non-revictimization, with 26 steps of action, ranging from: detection and correct identification of cases, advice, channeling and follow-up in cases where it is required to go before the corresponding criminal, civil or internal control authority, mediation or conciliation and legal representation.
