Government of Michoacán cancels debt of 1,740 million pesos


The state government will save more than 1,740 million pesos as the legal procedures promoted by the past administration to register with the Secretariat of Finance and Public Credit a contract for connectivity services, security monitoring and radio communication of the C5i, informed the governor, Alfredo Ramírez Bedolla.

“The contract was for the system to have direct intercommunication with police elements and patrols in order to deploy actions, but currently there is nothing, the C5i that they have delivered to us is literally a white elephant,” he said.

At a press conference, the president explained that by means of Legislative Decree 653 the Executive was authorized to acquire 12-year public debt, under the figure of Public Private Association (PPP), with the purpose of investing in C5i equipment, for which the government of the state contracted the services of the company SPE Michoacán Seguro.

Accompanied by the Legal Counselor of the State Government, César Ocegueda Robledo, the governor informed that for the payment of this debt, it was intended to make use of 100% of the resources collected by vehicle hologram, and 30% of the income obtained by the Payroll Tax.

It indicated that the construction processes of the C5i and the contracting of said company were irregular since it was carried out without authorization from the Ministry of Finance and Public Credit (SHCP) and payments were issued to the company without prior registration of the APP, as establishes the Public-Private Associations Law.

On two occasions, the previous administration carried out the process of registering the PPP contract with the SHCP; however, the registration was denied since payments had already been made to the company without complying with the provisions of the Public-Private Associations Law.

Given these refusals, the government headed by Silvano Aureoles promoted Constitutional Controversy 112/2021 before the SCJN and a Nullity Trial 1161/21-21-01-4-OT, before the Pacific-Central Regional Chamber of the Federal Court of Administrative Justice ; however, both procedures were dismissed due to legal actions filed by the current state government.

Ramírez Bedolla pointed out that, although the debt and the contract with the company are no longer in effect, the C5i must still be equipped, so this year the system will be reinforced and without indebtedness.
