They call for re-election regulations in the country

The presidents of the National Electoral Institute (INE), Lorenzo Córdova, and of the Electoral Tribunal of the Federal Judicial Power (TEPJF), Reyes Rodríguez, stated that the reelection in Mexico has imposed challenges for the electoral authorities, since the Congress continues in lacking with the regulatory law.

Within the framework of the Guadalajara International Book Fair, the president of the INE, Lorenzo Córdova, recalled that on March 18, 2020, at the dawn of the 2021 electoral process, the Chamber of Deputies approved a regulatory bill, but said initiative did not pass in the Senate of the Republic. “In short, there is no law,” he said.

He stressed that the INE had to approve guidelines on the matter in order to organize and guarantee the right of municipal presidents and federal and local legislators to compete for consecutive reelection.

“There are times in the INE that we are accused of invading spheres of the Legislative. Well, if it were fulfilled, each one, with the deadlines that have been given in the Constitution itself, perhaps this would not happen, which is not an exercise, without a doubt, desirable, but the certainty of the electoral processes becomes necessary ” , he raised.

In this context, Córdova said that a couple of months ago the Inter-American Court of Human Rights pointed out that indefinite re-election in some Latin American countries is contrary to the Democratic Charter and therefore, its prohibition does not violate the political rights of citizens. the right to be elected, but on the contrary, “limited reelection constitutes a guarantee of democratic survival.”

Magistrate Reyes Rodríguez said that for its application in the 2020-2021 electoral process, the figure of consecutive re-election imposed great challenges on the electoral authorities, from having rules to resolving conflicts over them, without a law on the matter.

The lawyer indicated that 65% of the federal deputies who sought the position for the second time, achieved their objective, the same as 25% of the local congressmen.

He made it clear that reelection is not absolute and it is necessary to analyze it within the framework of other constitutional rights.

For her part, the Minister of the Supreme Court of Justice of the Nation (SCJN), Norma Lucía Piña Hernández said that the figure of re-election should be considered “positively from another angle, from another time, with renewed hope in strengthening the values Democrats of Mexico ”.

“To understand the scope and limits of Mexican reelection, it is essential to go back to the past, in order to understand how reelectionist prejudice is formed, based on the authoritarian temptation of a reelected President and how that prejudice later reached the consecutive election of legislators, municipal presidents and governors ”, he mentioned.

No counterweights

On the other hand, Councilor Córdova regretted that currently the Legislative power is not a counterweight to power.

In his participation in the presentation of the book Re-election in Mexico: the new democratic challenge, regulation, implementation and relevant criteria, the official said that legislators privilege not changing the laws and reject the debate and the construction of democratic consensus.
