The urban man who killed the dog Sota, one step away from going to trial for animal abuse

The judge investigating Sota’s death, the bitch of a homeless man, for the shooting of a city guard in Barcelona has left the agent one step away from trial, accused of a crime of animal abuse, although he has sent him to a mediation process in search of an agreement with the owner of the animal.

As reported to Efe by legal sources, the head of the investigating court number 4 of Barcelona has closed the investigation of the case and has concluded that there are indications to send to trial both the urban man and the “homeless” owner of Sota, who is accused of a crime of assault for having tried to attack the agents when they killed his dog.

the animal died in December 2018 in Plaza España in Barcelona, for the shooting of an agent of the Urban Guard who maintains that he acted to fend because the bitch had pounced on him, with an aggressive attitude and feared that it would attack him.

Sota’s death sparked the outrage among animalists and unleashed a wave of protests and demonstrations in Barcelona, which in some cases resulted in incidents.

Three years later

Three years later, the judge has left the homeless man and the urban man who fatally shot the dog at the gates of trial, but not the other agent who accompanied him when the incident occurred and who was also charged because the owner of Sota He accused him of having beaten him.

However, the magistrate has agreed suspend the processing of the case and has sent to a mediation process the agent and the owner of Sota (who also exercises the private prosecution in the case) so that they can agree on a consent statement, to avoid holding the trial, in which the policeman would be exposed to penalties of disqualification and up to a year and a half in prison and homelessness, to up to four years in prison.

The decision to send the case to the criminal mediation service (which must now assess whether the circumstances exist to promote an agreement) has the support of the Prosecutor’s Office and of both investigated, but not of the popular accusation exercised by the PACMA and other animal organizations, under the same legal direction.

The facts

The urbane who shot the dog and its owner maintain conflicting positions regarding the facts: while the police maintain that the animal made a gesture of attack him and bit one of the agents on the elbow, the homeless man assures that he didn’t even bark at him.
