The dilemmas of the IFT

One less pending for the Senate of the Republic that since the last legislature has been ignored in the appointment of three honorary advisers of the Citizen Council of the Public Broadcasting System of the Mexican State; two commissioners and the president of the Governing Body of the Federal Telecommunications Institute, and three members of the Federal Competition Commission, including its president commissioner.

The intention of the majority bench in the Senate of the Republic is to conclude the evaluation process before the end of the year. Candidates for Cofece are: Francisco Eleazar Castillo Cerdas, Juan Manuel Espino, Armando Cuauhtémoc González Palacios, Andrea Marvan Saltiel, Luis Horacio Reyes de la Rosa.

The list of applicants to the IFT is made up of workers from that institution: Carolina Cabello Ávila, Laura Elizabeth González Sánchez, Gabriela Gutiérrez Salas, Jrisy Esther Motis Espejel and Lorely Ochoa Monsiváis.

A year ago, the Plenary of the IFT was left with five members and was incomplete, due to the omission of the bodies in charge of proposing and appointing two new commissioners.

In the last promotion, the Evaluation Committee did not sufficiently qualify the applicants who took the knowledge test. This time the five candidates are part of the organic structure of the Institute and three of them – González Sánchez, Motis Espejel and Ochoa Monsiváis – had already participated in previous processes for a seat in the Plenary.

According to internal sources, Carolina Cabello has the support of the current interim president and Lorely Ochoa, of the former president commissioner, Gabriel Contreras. The best qualified is Gabriela Gutiérrez, whose profile is 100% technical.

Two weeks remain for the end of the regular session of the Senate of the Republic, which must validate the proposal sent by the federal Executive. In February the period of Cuevas Mejía will conclude and then another vacancy will remain.

This specialized and autonomous regulatory body for the development and efficient provision of telecommunications and radio broadcasting in Mexico is barely eight years old. In the last stage, the IFT has fulfilled more with collection functions. At the end of the third quarter of 2021, it had captured 141.7 million pesos for the use of frequencies, uses and procedures.

In the period, the high costs for the use of radioelectric frequencies is a flag that the members of the IFT Plenary have embraced because in their opinion they reduce the resources allocated by the operators to satisfy the demand for data of the users, which affects to the quality and availability of services, slows down technological innovation and prevents the expansion of coverage.

The phenomenon, in any case, is not recent. In 2019, one of the three operators with infrastructure returned the spectrum that had already been granted in the 800 MHz, 850 MHz, AWS, PCS and 2.5 GHz frequency bands, on the grounds of high costs, and decided to lease a part of those frequencies to another operator to continue with the provision of its services.

This maneuver implies that the State stops receiving 4,500 million pesos annually for the returned spectrum.

In the last tender for spectrum for mobile services, two months ago, the IFT only received offers for three of the 41 blocks auctioned. Among the 38 blocks that were left deserted, there was one with a minimum reference value of 89 million pesos.

The expensive radioelectric spectrum inhibits investors, according to commissioners, and if this trend continues, there could be an eventual exit of network operators in the Mexican market. They insist on modifying the Federal Law of Rights to reduce the amounts to be paid for the use, exploitation and exploitation of the spectrum.

Current legislation allows incoming mayors to take office in the month prior to the start of their three-year terms. And Governor Alfredo Del Mazo will tour around twenty municipalities in the next two weeks, invited by the councils.
