State Pact and the ‘trans law’: LGTBI claims before Pride 2022


After two years marked by the pandemic and social restrictions, the LGTBI+ collective plans to once again fill the streets with rainbow flags and demands on the occasion of the international pride day, which is celebrated on June 28. In Barcelona the main demonstration will take place this Saturday with the main request for the visibility of lesbians. Meanwhile, in Madrid it has been delayed until July 9 so that it does not coincide with the NATO summit. In any case, these are days full of acts in search of equality, diversity, inclusion and freedom because although there has been progress in the last year, there are still many burdens and discrimination that grip the group.

Work to eradicate violence against the LGTBI+ collective, the legal modification to prohibit reconversion therapies and the official recognition to place LGBTI+ flags in public buildings will be the main demands of the demonstrations throughout Catalonia, he explains Eugeni Rodríguez, president of the Observatory against homophobia.

The LGTBI+ State Federation considers that the pandemic has left behind more “invisibility” towards lesbian, gay, trans, bisexual, intersex and other people, as well as Hate crimes have increased suffering. Statistics from the Ministry of the Interior indicate that attacks based on sexual orientation and gender identity are the third most numerous among hate crimes, behind those based on ideology and racism. Since they began to be counted in Spain in 2014, they have not stopped grow at a rate of 9% per yearand that is the attacks that are known, because the problem lies in those that are not reported. A study carried out by Interior in 2021 reveals that 89% of those surveyed who have been victims of hate crimes have not reported them.

The rejection is manifested above all in the social networks, under the umbrella of anonymity. According to the latest data from oberaxethe Spanish Observatory of Racism and Xenophobia, from March and April 2022, the number of contents with hate messages identified and communicated to the Facebook, Twitter, YouTube, Instagram and TikTok platforms was 494, which represents an increase of 27 % with respect to the previous bimonthly bulletin.

The changes

Behind this increase, according to the president of the State Federation, Uge Sangil, is “the speech of the far rightwhich resonates more every day” along with vox it is managing to conquer more levels of central and territorial power. To curb hate crimes, the movement calls for toughen the penal code in order to put an end to “impunity” and give more training to both LGTBI+ people and the security forces, so that there is an increase in complaints and the police know how to respond to them.

Likewise, the community longs for the approval of the LGTBI state law, better known as ‘trans law’, that contemplates new rights, anti-discrimination sanctions and, above all, recognizes the gender self-determination to trans people, who will be able to change their sex in the DNI and the Civil Registry with their mere request, without showing two years of hormone treatment and having a medical guarantee.

The norm will foreseeably be approved on Monday in the Council of Ministers for its remission to the Cortes, where the group will fight for the introduction of amendments that recognize the new rights to all immigrants, regardless of their administrative situation. and that the minors 12-year-olds can change sex if they demonstrate maturity and reaffirmation over time, as has been marked by a Constitutional ruling.

At the same time, it will request that rights be recognized for non binary people(those who do not identify with the masculine or feminine gender), if this aspect has not already been introduced in the bill that the Government will approve.

In addition, the LGTBI + State Federation is working with other organizations and unions in search of a social and political pact that defends the collective, similar to the State pact against sexist violence that was forged five years ago and that has been recently ratified, without the support of Vox.
