Profeco threatens airlines with imposing violations for extra charge of hand luggage

The Federal Consumer Prosecutor’s Office (Profeco) insisted to the airlines AeroMexico, Long live Aerobús and Volaris to eliminate the fee for hand luggage to avoid legal actions against them, because they could incur in abusive commercial practices that “violate the rights of passengers recognized in the Constitution, the Federal Consumer Protection Law and the Aviation Law Civil”.

The Attorney General insisted that this warrant is given in accordance with the criteria of the Supreme Court of Justice of the Nation (SCJN), “as hand luggage is considered an inherent element of the air transport service”.

The Profeco He warned that in case of not attending to this request, an alert will be issued and procedures will be initiated for infractions of the Law.

The agency detailed that derived from the monitoring carried out on the airlines’ websites carried out last week, the airlines were urged to stop these “abusive practices” consisting of the commercialization of flights with fares that do not include the right to transport luggage. carry-on and establish additional charges to carry this type of luggage.

Article 47 Bis, section IX, third paragraph of the Civil Aviation Law, establishes that: ‘… the passenger may carry up to two pieces of hand luggage in the cabin.
