Lower House formalizes controversy by INE agreement

The president of the Chamber of Deputies, Sergio Gutiérrez Luna (Morena), yesterday filed a constitutional controversy before the Supreme Court of Justice of the Nation, against the agreement of the National Electoral Institute (INE) to postpone the consultation on the Revocation of Mandate .

In the words of the legislator, said agreement of the electoral authority “violates human rights that have to do with citizen participation.”

According to the Lower House, after a detailed legal analysis, various constitutional irregularities were observed that invade the sphere of competence of this legislative body in the exercise of its exclusive powers in budgetary matters and its powers in terms of Revocation of Mandate.

It was reported that violations of rights were detected, such as participating in Mandate Revocation processes.

“In order to defend the interests of the Chamber of Deputies, and in view of the fact that it is in recess, the president of the Board of Directors, Sergio Gutiérrez Luna, decided, in exercise of the powers conferred by law, based on the provisions of articles 23, numeral 1, subsection l), of the Organic Law of the General Congress of the United Mexican States, as well as 233, numeral 2, of the Regulations of the Chamber of Deputies; present before the Supreme Court of Justice of the Nation a constitutional controversy claim against the INE ”, it was detailed.

The document, presented by the legal representative of San Lázaro, Luis Genaro Vázquez, before the SCJN, requests the suspension of the INE agreement so that the institute refrains from temporarily postponing any of the activities for the organization of the process Revocation of the Mandate of the President of the Republic

They review more than 7 million signatures

For its part, the INE reported yesterday that it is already verifying around 6.1 million citizen signatures that it has received so far on paper and 1 million 44,630 signatures collected through application, by various civil organizations that request that a Revocation of Mandate.

The counselor Claudia Zavala assured that the INE guaranteed that this exercise of citizen participation will be carried out, and it should only be defined whether or not the model can deviate from what is provided for by the Constitution and the Law.

“The consultation is being carried out, it is going to be carried out and what we are seeing is the modality under which it will be organized. There are alternatives to carry out this exercise, but these have variations with respect to the model required in the Law of Revocation of Mandate, therefore the relevance of going to court ”, he highlighted.

He added that the INE will abide by what the courts decide.
