Income from CNH harvesting falls 3.7%

Income from exploitation that the National Hydrocarbons Commission (CNH) charges oil contract operators for the administration services it offers them fell for the fourth consecutive year, adding an amount of 620.8 million pesos, which was 2.8 times its annual budget. , but which had a reduction of 3.7% compared to 2020, the regulator reported in its last session of the governing body of the year.

These revenues were lower despite the fact that oil activity improved after the close of activities in 2020, although in contrast, the previous year the reduction in these revenues was 34% compared to 2019.

After having received income of 989 million pesos in 2016, this amount increased 40% in annual terms upon reaching 2017, reaching its maximum level of 1.39 billion pesos that year thanks to the large tenders in which contracts were awarded for association with Petróleos Mexicanos (Pemex).

However, derived from the fact that it stopped carrying out oil rounds and that the contracts have had delays in their operating plans, which are added to the maturity times of the largest projects such as deep waters, as of 2018 these revenues began to fall : by 12% per year that year and up to 21% by 2019, in addition to 34% in 2020, with which the 3.7% reduction for this year was the lowest in the last five years.

It should be remembered that according to the rules that were modified for regulators in 2014, in which their own Law was designed, both the CNH and the Energy Regulatory Commission (CRE) can conserve an amount of uses of up to three times their budget, which they can use for their work.

Thus, both in 2017 and 2018, the CNH received the income and even obtained remnants to send to the Treasury, a situation that does not occur today.

The trust

With this, the Trust of the National Hydrocarbons Commission will receive 177,949 million pesos that next year will be used for the regulator of hydrocarbon exploration and production activities in the country to carry out its functions.

Based on the energy reform, it was determined that the CNH can receive resources through rights and uses by its regulated entities. If these resources are three times the regulator’s budget for the previous year, they will be deposited in a trust administered by a banking institution.

The resources of the Trust, prior approval of the Technical Committee previously selected to make decisions about its destination once it has complied with the provisions of the Law of Coordinated Regulatory Bodies in Energy Matters (LORCME), will be used to defray the necessary expenses to comply with the Attributions conferred on the Commission, in accordance with its authorized budget and respecting the principles of the operation of trusts referred to in article 134 of the Political Constitution of the United Mexican States.

In transitory article 12 of the Decree by which various provisions of the Constitution on energy matters were amended, it was established that the CNH will be able to dispose of the income derived from the contributions and uses that the law establishes for its services in the issuance and administration of the permits, authorizations, assignments and contracts, as well as the corresponding services according to its powers to finance its budget that allows it to comply with its powers.

Therefore, as of November 30, the CNH received income from exploitation paid by the operators for a total of 620,810 million pesos and of these, 448,896 were applied for the operation of the regulator, with which a remainder of excess income of 171,914 million was subtracted. pesos, but as of December 15, 6,034 million were added, with which the CNH has 177,949 million pesos that fall into the possibility of being transferred to the Trust.
