IFT, strategic value

 

Regarding the Telmex concession that the Federal Telecommunications Institute (IFT) clarified has already been extended, the respective presidential declaration raised a lot of dust.

They say that in politics there are no coincidences and for many analysts, what President López Obrador said was not a confusion or lack of information, but a statement with encrypted messages.

One of them could be aimed at the field of telecommunications, both for the companies that participate in that market and for the regulatory body itself.

Could be. But beyond speculations, what is clear is that the first president of the Nation does not like the autonomous bodies, he has said it publicly and has acted accordingly. He tried to reduce the salary of his civil servants, reduced their budget and in some cases took them over. The Cofece and the IFT are kept with the minimum number of commissioners. At the exit of the Antitrust Commission of the former president Jana Palacios, only four commissioners remain and with the next exit – in February – of the interim president Adolfo Cuevas of the IFT, he will also be left with the minimum number of 4 commissioners .

It is foreseen in that body that the replacement of Cuevas will automatically be the commissioner with the longest service: Javier Juárez.

The IFT will have enough quorum to issue general resolutions, but for some issues it will require five commissioners.

Obviously, in both cases, Cofece and IFT are and will be operating with the minimum number of commissioners necessary.

It is rumored that the government intends to “absorb” the IFT into the structure of the Ministry of Communications and Transportation.

It must be remembered, on the other hand, that the autonomous bodies, the IFT among them, were created precisely to prevent political decisions from being made instead of technical ones.

In the case of the IFT, its regulatory autonomy is fundamental, it has a strategic value, because it has to do with concessions.

It would be very risky – if the rumors of absorption of the IFT by the government were true – to touch the IFT. It would imply touching the Constitution and in the international arena, it would imply touching the T-MEC.

We will see what decisions are made.

LIF, practically unchanged

As in the best times of the PRI steamroller, the majority party in power, Morena, achieved the approval, practically without changes, of the Federal Revenue Law and the Fiscal Miscellany for the year 2022.

Of the fiscal miscellany for 2022, despite the shouts and hats off, the incorporation of the Simplified Trust Regime for individuals and legal entities was approved.

The mandatory registration of young people from 18 years of age to the Federal Taxpayers Registry (RFC).

And a limit to the tax deduction for donations, by including them within 15% of the total deductions.

The Senate has until October 31 to approve or modify the ruling.
