Fonatur challenges suspension of Section 5 south of the Mayan Train


Cancun, QRoo.-After complying with the provisional suspension of the works of the Section 5 south of the Mayan Trainthe National Fund for the Promotion of Tourism (Fonatur) challenged this measure, granted by the first district court of Yucatan.

The challenge was filed last Friday, April 22, by Adrián Fernando Novelo, legal representative of Fonaturagainst the protection claiming the right to a healthy environment filed by a group of divers-cavers who were granted the provisional suspension of the works.

As long as this appeal is not resolved, as well as the incidental hearing of the amparo trialpostponed for next May 13, the works will remain stopped.

The federal government had previously challenged a previous injunction that annulled the Environment impact manifestation (MIA) of sections 1, 2, and 3 approved by the Secretary of Environment and Natural Resources (Semarnat) in 2020 and therefore the works had to stop immediately.

The challenge against that resource, promoted by the Semarnatmotivated a federal court in Mérida to annul the amparo, arguing an “error”, since it supposedly resolved separately two appeals for review against the same sentence that definitively suspended the works of the Mayan Train until it was resolved in substance. the case.

The court justified itself by saying that the appeals for review against that amparo were sent separately and unrelated, which led to two different rulings regarding the same case, one that annulled the suspension and the second that maintained the suspension of the MIA.

Said amparo, ultimately without effect, was promoted by residents of Campeche, Yucatan, Tabasco and Chiapasalleging damage to the environment and their right to live in a healthy environment.
