Federal Judiciary Council investigates magistrate for ties to drug trafficking

The Federal Judicial Council (CJF) is also administratively investigating the professional performance of magistrate Isidro Avelar Gutiérrez – currently a prisoner – for allegedly issuing sentences that favored the Jalisco Nueva Generación Cartel (CJNG).

In parallel to the criminal process that the Attorney General’s Office (FGR) initiated against Avelar, the General Unit for the Investigation of Administrative Responsibilities of the CJF is processing an investigation against Avelar for acts of corruption related to drug trafficking.

Among the alleged favorable resolutions of the judge to the CJNG is the release order that he ordered at the time for Rubén Oseguera González, alias el Menchito, son of Nemesio Oseguera Cervantes, el Mencho, absolute leader of the CJNG.

“The role of the accused within the organization is unknown at the moment, which is why he insists that it is not something robust to fix the link or possible relationship, even in an incidental way, with said Cartel,” said a document of the CJF.

Anomalies in heritage

Judge Avelar is currently suspended from the CJF. He was arrested on November 22, 2019 in Guadalajara, Jalisco. He was linked to the process, and is currently imprisoned in the federal prison of El Rincón, in Nayarit.

According to the FGR, Avelar Gutiérrez irregularly increased his perceptions by 12 million 20,474 pesos while he served as a magistrate in 2011.

He was even pointed out at the time by the United States Department of the Treasury of having a relationship with the Jalisco Nueva Generación Cartel, as he would have received ranches; cash, real estate and vehicles in payment for their resolutions.

In July of this year, the Sixth Unitary Court of the State of Mexico refused to grant an amparo to the magistrate, who sought to free the process that is being followed for illicit enrichment derived from a deposit of more than 12 million pesos.

Last May, the Federal Judiciary Council temporarily suspended Avelar without pay for six months, noting strange financial operations under his charge, which could come from illicit sources.
