Employer sector urges Congress to issue private security law


After a delay of seven months, it is urgent that the Congress of the Union issue the General Law of Private Security to help with private security and avoid the proliferation of ghost companies, he fought the Employer Confederation of the Mexican Republic (Coparmex).

The business body led by José Medina Mora said that the maximum term to issue the law expired on November 25, 2021, and it is of the utmost importance that it be put into effect since it intends to regulate private security in three aspects: the homologation of a single permit at the national level to create a national registry of companies that provide the service in one or several states, establish the distribution of powers that the federation, the states and the municipalities will have in the matter and sanctions for both companies and users who hire companies that do not have the corresponding authorization.

Through a statement, Coparmex established that it is urgent to carry out the national registry of private security companies, since according to the Supreme Court of Justice of the Nation (SCJN), are contributors to public safety.

“At Coparmex we are concerned about the professionalization and regulation of private security companies and, furthermore, we are interested in this sector incorporating best practices into its processes that benefit all Mexicans, therefore, we urge the issuance of the Private Security Law in order to have the secondary regulation that makes the constitutional text a reality,” he assured.

For the business sector, it is essential that the Private Security Law be issued so that there is an effective and adequate regulation and the rnational registry of companies in the industrysince currently it is only carried out when a company has activity in two or more entities, but when it works only in one, it only has the obligation to carry out its registration before the federal entity in which it provides the service.

He recalled that in the last decade, the social and public security reality exceeded the constitutional obligation of the Mexican State, which gave rise to the proliferation of private security companieswith all kinds of distortions in the activity of a sector that represents more than 8,000 companies, employs more than 600,000 employees, and represents approximately 2% of the Gross Domestic Product (GDP).

Faced with this situation, on March 11, 2021, a constitutional reform initiative was approved to article 73 in order to empower the Congress of the Union to legislate and issue the General Law of Private Security, whose regulation was published on May 28, 2021. 2021 in the Official Gazette of the Federation, after the approval of the majority of local congresses, as dictated by law.

For this reason expressed by the highest body of the Judiciary and the reasons mentioned above —explained Coparmex— it is essential to have an adequate legal framework for the best development of this sector.

The General Law on Private Security will provide greater coordination, monitoring and control tools to the authorities of the three areas of government, in favor of citizens.
