The Court of Justice of the Republic (CJR), the only body competent to investigate acts committed by ministers during their mandate, intends to continue its investigations, despite the upcoming electoral deadlines … and the obstacles scattered in its path, in particular by political power.
According to information from World, two court cases are highly likely to disrupt the course of the presidential campaign: the management of the health crisis and the Dupond-Moretti affair. In the first, the magistrates intend, in fact, to prosecute personalities having belonged or belonging to the government; in the second, they intensify their investigations on the keeper of the seals, indicted since July 16 for “illegal taking of interests”. Two embarrassing investigations for the executive as they threaten to shed a harsh light on the dysfunctions of the government machine since 2017.
From sources close to the file, the former Minister of Solidarity and Health (May 2017-February 2020) Agnès Buzyn is thus summoned for an indictment, Friday September 10, at 9 a.m., by the investigating magistrates of the CJR.
Appointed in January “envoy of the Director General for Multilateral Affairs” to the World Health Organization (WHO), Mr.me Buzyn had not complied with a first summons of the CJR, in July; an evasion little appreciated by the investigators. The magistrates therefore drew up a report of non-appearance targeting the former minister, before sending him a new summons. Presumed innocent, the former minister can still hope to leave with the status of assisted witness. Ni Mme Buzyn and his lawyers did not respond to the World.
Contradictions
The three judges – Janine Drai, Bruno Lavielle and Catherine Schneider – blame the former minister for his management of the crisis linked to Covid-19, and in particular the lack of anticipation of his administration: they therefore plan to indict her for two distinct reasons: “voluntary abstention from fighting a claim”, an offense initially targeted by the judges, but also, from now on, “endangering the life of others”.
This last incrimination supposes the deliberate violation of a particular obligation of prudence and safety. In this regard, the judges rely particularly on Decree 2017-1076, signed by Mr.me Buzyn on May 24, 2017, in which it is stated as follows: “The Minister of Solidarity and Health develops and implements (…) the rules relating to the health protection policy against the various risks likely to affect it. “
