CNDH determines that Aburto declared under torture

The National Human Rights Commission (CNDH) determined that Mario Aburto, accused of the murder of presidential candidate Luis Donaldo Colosio, was tortured during his arrest in 1994.

When disclosing the results of its report on the complaint file CNDH / 6/2021/1261 / VG in which the complaint of torture by Aburto Martínez was investigated, the Commission indicated that both the accused, as part of his family, they were tortured.

And it is that what the Recommendation issued by the CNDH could prove is that Mario Aburto “was tortured since his arrest on March 23, 1994, as well as some members of his family, he repeatedly until recent years.”

Likewise, it was highlighted that such illegal acts were aware of it, “as well as those responsible for the official investigation and the National Commission itself, however, they minimized and even disavowed it. All in order to support the official version of the ‘lone murderer’ ”.

The CNDH added that from the moment of his arrest, in Lomas Taurinas, and several times during the first interrogations, Mario Aburto denied being responsible for the events; He stated that he was a victim of torture and that he was pressured to accuse himself, which was contrary to what those responsible for the investigation said.

While testimonies of witnesses to torture were discredited or minimized, including those who participated in it and declared it to the authorities. In addition to the fact that the information contained in the various medical examinations that were performed between the time of his arrest in the delegation of the then Attorney General’s Office (PGR) in Tijuana and his entry to Cefereso 1 of Almoloya, that is, , between March 23 and 25, 1994.

It indicated that in clarifying these facts, the CNDH included documents, expert opinions and testimonies that were ignored or eliminated from the official investigation, such as Aburto’s testimony and parts of an interview with him by CNDH personnel, presumably on April 12, 1994. , which, although it is in his file, does not appear in the official investigation or in any follow-up file of the agency’s complaint regarding the torture denounced, because it was never formally integrated.

The CNDH recalled that on October 26, the institution issued Recommendation 48VG / 2021 to the Office of the Attorney General of the Republic and to the Decentralized Administrative Body for Prevention and Social Readaptation, for having accredited torture to the detriment of Mario Aburto, who is currently in Cefereso 12 in Ocampo, Guanajuato.

This arrest was the result of the official investigation that four special deputy attorneys conducted between 1994 and 2020, for which he was sentenced as responsible for the murder of the candidate of the Institutional Revolutionary Party.
