CDMX publishes new administrative and operating changes; seek economic recovery


As part of the last three economic recovery packages, the Government of Mexico City announced new administrative changes, for example, the agreements for the reconversion of offices, the unification of construction studies, as well as the modifications to the Special Program for Urban Regeneration and Inclusive Housing.

According to what was published in the Official Gazette, there are a total of six agreements and resolutions that aim to accelerate the economic development of the city, after the Covid-19 pandemic.

The first agreement is the modification to the guidelines for the Reconversion of Offices to Housing in Mexico City and focuses on allowing an office space to become a home, and thus be marketed.

The new guidelines specify that disused or abandoned properties are those built and in operation until March 31, 2020, when the declaration of a health emergency was issued in Mexico City.

“Those buildings that are offices and shops built with occupation with functional obsolescence will be eligible; those built in disuse or in abandonment; as well as low-impact industrial buildings built with occupation and with functional obsolescence; and those with a low-impact industry and in disuse or abandonment”, stressed the issued document.

To do this, the properties must be located in areas such as the Historic Center, Santa Fe, Polanco, Granadas, Avenida Paseo de la Reforma (in the section from Avenida Hidalgo, to Fuente de los Petróleo), Avenida Revolución, Avenida Insurgentes Sur (in the section of the Caminero Monument to the intersection with the Peripheral Ring), Insurgentes Avenue, North Insurgentes Avenue (in the section of Ribera de San Cosme Avenue and Mexico Tenochtitlán, up to Ricardo Flores Magón) and the Peripheral Ring (in the corresponding sections that are are within the territorial demarcations of Benito Juárez, Coyoacán, and Miguel Hidalgo).

The second agreement to improve the economy of the city is the Procedure for the presentation of Urban and Environmental Impact studies through the “Single” and “Digital” windows, as well as the creation of the Single Impact Commission.

This new action aims to integrate the different construction evaluation processes in a single digital file, as well as the simultaneous issuance of urban impact reports and environmental impact authorizations.

The projects that can enter into this new administrative simplification are those that are aimed at creating housing with more than 10,000 square meters of construction (considering social housing, popular housing), as well as schemes for offices, shops, services, industry, equipment or any use other than housing with more than 5,000 square meters of construction.

Mixed-use projects (housing, commerce, services or equipment) with more than 5,000 square meters of construction (with the exception of those destined for social and popular interest housing) can also enter.

At the same time, the “Single Window” is created to present applications for urban impact reports and environmental impact authorizations in person; this will be located in the facilities of the Ministry of Urban Development and Housing.

Meanwhile, the Single Impact Commission is created as a collegiate body of the Government of Mexico City in charge of monitoring requests and evaluating Urban and Environmental Impacts, as well as the opinions and authorizations issued.

“This instance will also monitor compliance with the urban integration measures that have been indicated in the urban impact reports and the environmental mitigation measures that are imposed in the environmental impact authorizations,” the Official Gazette stressed.

Meanwhile, the third agreement is for the Special Program for Urban Regeneration and Inclusive Housing, the new changes focus on reducing inclusive housing per project from 30% to 20%, as well as its sale costs, from 1 million pesos to 1.4 million.

At the same time, by 2022 there will be seven zones that will be included (Historic Center: polygon “A” and “B”, Atlampa, Vallejo I, Tacubaya, Granadas, Zona Rosa and Calzada de Guadalupe), as well as 18 corridors.

The fourth change of the three economic packages is the resolution of a general nature through which forgiveness is granted in terms of Property Tax in favor of taxpayers 58 years of age or older, without fixed income and with limited resources, who are owners of the ground.

The tax benefit applies as long as the property is for residential use and its cadastral value does not exceed 2.3 million pesos, so that only the fee of $55.00 pesos bimonthly is paid.

If the cadastral value is higher, a remission of 30% of the tax payment will be applied, starting in the second two months of the 2022 fiscal year.

The fifth is the agreement by which “administrative facilities are granted to the Housing Institute of Mexico City to streamline the processing of the Notice of completion of works that do not require a Construction Manifestation or a Special Construction License for Real Estate Projects destined for Housing. of Social or Popular Interest”.

Here the objective is to simplify and facilitate the procedures for the execution of housing projects of social or popular interest for the benefit of priority attention groups.

The sixth axis is the resolution to condone 100% of the Payroll Tax for MSMEs that open this year, the tax benefit will be during the first three months of operation.

“This resolution will apply in favor of micro and small companies, individuals or legal entities that have suspended activities since March 1, 2020 and restart their activities from the day of entry into force of this instrument,” the document added. official.

To obtain the benefit, taxpayers must be registered, or register, in the Payroll Register of Mexico City.

It should be noted that last week the three new packages of additional actions to reactivate the economy of the capital were presented during the General Assembly of the Economic, Social and Environmental Council of Mexico City.

The three packages (these are support from the popular, social and solidarity economy; new instruments to support construction, housing and the economy in general; and actions to relaunch the tourism, cultural and Historic Center sectors) come to reinforce the economic reactivation plans (which have been executed since the second half of 2020 and throughout 2021).

According to the head of government, Claudia Sheinbaum Pardo, the three new packages initially aim to generate more than 100,000 new jobs and create more than 17,000 companies in 2022.
