Caintra and Prodecon sign an agreement to advise MSMEs in complicated tax procedures

Monterrey, NL. The Chamber of the Transformation Industry of Nuevo León (Caintra) signed a collaboration agreement with the Taxpayer Defense Attorney (Prodecon), to support micro, small and medium-sized enterprises (Mipymes) with advice, defense and tax training in procedures before the Tax Administration Service (SAT), Infonavit and IMSS.

Guillermo Dillon Montaña, general director of Caintra Nuevo León commented that they found an ally in Prodecon to support MSMEs in tax advice, defense and training, because these companies have the same obligations as large corporations, for example, they must comply with 175 calculations, declarations or payments per year, a situation that contrasts with the United States where only 18 calculations are made.

“SMEs require that their taxation be as simple as possible, therefore the agreement that we signed today will allow us to enhance Caintra’s services, with direct advice on tax matters, taxes before the SAT, Infonavit and the Mexican Institute of Social Security”, he emphasized Dillon Mountain.

He added that the 3,500 members of the Chamber will be able to find a lawyer at Prodecon at no cost, to support them on issues such as tax credits, this is in addition to the advice and training that the agency offers monthly with three workshops on tax issues.

For his part, Cristian Nazael García Olalde, Prodecon delegate in Nuevo León, commented that this agreement will last two years and can be endorsed, the objective of the agreement is for MSMEs to have direct contact with Prodecon, through Caintra , and can formulate any problem they have.

For example, if they had an Audit in process, “we have the figure of the Conclusive Agreement, it is an alternative means of dispute resolution, where Prodecon acts as an intermediary, with the tax authority, we help them to prepare the request, to present it, we suspend the audit immediately, if it is not through the Attorney General’s Office, that allows them to provide evidence and arguments, to avoid a tax credit, ”emphasized García Olalde.

The benefit is that they are supported immediately. Contributors can be approached through face-to-face appointments or by zoom; however, with the agreement with Caintra, they will be able to approach them directly, and contact them to see what the strategy is to support the taxpayer.

Problematic

There are several issues that have been presented, such as VAT refunds, however, the one that most affects mypimes is the cancellation of the digital stamp, what Prodecon has achieved in many cases is to explain the case to the authority. “For example, a taxpayer who had debts canceled his digital stamp, and he told us I have no flow and I cannot pay until I can generate an invoice, we spoke with the SAT, he was allowed to pay the difference and he was able to continue using his digital stamp “, explained the official.

“The benefit that Prodecon has is that when everything gets stuck, to restore it you need to give a vote of confidence to the businessman to comply, these cases frequently go through Caintra, conflicts they have in foreign trade matters, returns of VAT, and in strict adherence to the regulations, you need someone to support you to resolve and for the company to recover its flows, sometimes the regulations are very rigid, although the will of the employer is to comply “, stressed Dillon Montaña.
