Biden government prepares new rule to preserve DACA after court ruling

The The Biden government announced Monday that it will create a rule to reissue the Deferred Action for Childhood Arrivals (DACA) policy., after a Texas court declared the program illegal and suspended the Dreamers’ ability to apply for protections.

The Context: The Department of Homeland Security (DHS) announced that the rule will “preserve and fortify” the DACA program and its implementation. A federal judge in Texas ruled in July that the 2012 DACA rule violated the Administrative Procedures Act.

  • The decision left intact the benefits of the program for some 600 thousand people that they would not be able to obtain legal status after arriving in the United States as children, but it blocked any future applications and left thousands of young immigrants in limbo.
  • The Biden administration appealed the decision earlier this month.
