Authorities issue a seventh extension for unions to renew union leadership

The Federal Center for Labor Conciliation and Registration (CFCRL) issued the first extension – plus 6 others published by the Ministry of Labor and Social Welfare – so that trade union organizations registered with the Local Conciliation and Arbitration Boards of all states, as well as those registered with the General Directorate for the Registration of Associations , whose directives or leaders have lost validity due to the pandemic, will be considered extended from November 3, 2021 to March 31, 2022.

The foregoing allows trade union organizations to carry out all the processes and procedures that are at the door, “as is the case of the strike due to salary and contractual reviews,” said Alejandro Avilés Gómez, president of the Labor Lawyers Association of the Mexico City.

In this sense, trade union organizations may request the certification that they are subject to the extension, provided that they are located in the case (s) presented by the labor authority.

The Agreement, published this day in the Official Gazette of the Federation (DOF), protects those union organizations whose validity of the certificates or notes were granted by the then General Directorate of Registration of Associations of the Ministry of Labor and Social Welfare, with respect to the directives or leaders of the unions that conclude or have concluded between March 23, 2020 and March 31, 2022.

Also, those that the validity of the certificates or notes were granted by the Local Conciliation and Arbitration Boards of all the Federal Entities with respect to the directives or leaders of the union organizations, conclude or have concluded between November 18, 2020 and until March 31, 2022.

It should be noted that the Federal Labor Law and the ILO point out that a union can be constituted by the fact that the workers so decide, but they must have a recognition of an administrative authority, which in this case in Mexico the Taking of Note is issued, in order to carry out the representation of the workers in all negotiations.
