Despite a cover on the accused, the mother would have seen that the 39-year-old man she had been dating for a few months had an erection and the pants were at mid-thigh. Troubled, the woman said that she went to the bathroom to absorb the scene while the accused would have pulled up her panties quickly, pretending that she had seen nothing.

Touching the penis

The woman left with the seven-year-old victim on the pretext that she wanted to clean her house. It was a little later in the car that she would have asked the child if he had “touched Nicolas’s penis”.

“He didn’t want to talk, he was afraid of going to prison,” said the witness while confirming that the child had finally answered her question in the affirmative. A complaint to the police was then made. “I had no doubts about what I saw,” she said, convinced.

The woman, solid during her story, however, broke down in tears when it came to the question of the purpose of her pregnancy. “I wanted to make sure that never [Nicolas St-Pierre] wouldn’t have any other contact with my children, so I had an abortion,” she said in a muffled voice.

The events recounted occurred in January 2018, that is to say more than four years ago. Given the delay, Nicolas St-Pierre’s lawyer made a Jordan-type motion for unreasonable delay.

However, Judge Annie Trudel decided to hear the Crown’s evidence before hearing the motion. The defense will plead this request on Friday morning after which the judge has already announced that she will take the matter under advisement.
