AMLO will leave on October 1, 2024. Neither before nor after

On February 10, 2014, a decree was published in the Official Gazette of the Federation that amended, added and repealed various provisions of the Political Constitution of the United Mexican States on political-electoral matters, including Article 83.

Until that day in February, the 83rd said: “The President will take office on December 1 and will last for six years …”.

Already reformed, the 83 indicates that “The President will enter to exercise his position on the 1st. October and will last six years… ”.

Transitory Article 15 of the aforementioned decree determined that the amendment to 83 would enter into force on December 1, 2018, “therefore the presidential period between 2018 and 2024 will begin on December 1, 2018 and will end on December 30, 2018. September 2024 ”.

Another constitutional article, 86, which has not been amended since the Constitution was promulgated on February 5, 1917, notes that “The office of President of the Republic can only be waived for serious reasons, which will be qualified by the Congress of the Union, to whom the resignation will be presented ”.

What is a serious cause? Nothing in the Constitution explains it, but various jurists who have opined on the matter say that among them the following could be considered: that the president be convicted of serious crimes such as treason, espionage, terrorism, sabotage or genocide, or that he is physically or mentally impaired.

In the presidential election of July 1, 2018, Andrés Manuel López Obrador obtained 53.2% of the votes cast and a month later, on August 8, the then president of the Electoral Court of the Federal Judicial Power, Janine Otálora, He delivered the certificate that accredited him as president-elect of Mexico.

In its last paragraph, the record notes: “… Citizen Andrés Manuel López Obrador, candidate nominated by the Juntos Haremos Historia coalition, obtained 30 million 110,327 votes, with which he obtained the majority in the election and satisfied the eligibility requirements: consequently, he declares President Elect of the United Mexican States, for the period from December 1, two thousand and eighteen to September 30, two thousand and twenty-four ”.

In summary: AMLO was elected for the period noted in said certificate and will only be able to resign from office for serious reasons. It is ordered by the Constitution that he swore to fulfill and enforce.

All of the above is relevant because last Friday, to presume that he is a 100% democrat, Andrés Manuel announced that he will abide by the result of the consultation to revoke his mandate that will be held in March 2022, although less than 40% of the register electoral participates in it and a majority of the votes are in favor of revoking the position.

The president offered the above, knowing full well that there will be more who are in favor of him remaining in office than those who do so against. I don’t think he would have made such an offer if 60% of Mexicans disapproved of his management.

He also knows that he was elected to be president for the period noted on the certificate he received in August 2018 and that he will go to his ranch in Palenque until October 1, 2024; not a day before or after.
